NYS FEP Guidance Update: What You Need to Know

New York State has adopted a statewide transition requirement for school transportation. Under the current mandate, any newly purchased or leased school buses must be zero-emission beginning July 1, 2027, and school districts must transition their full bus fleets to zero-emission by July 1, 2035.

Recent Updates

Districts are strongly cautioned not to apply for an Extension Waiver unless it is absolutely necessary to meet transportation service needs for the coming school year. Applications are accepted on a rolling basis until March 1 of each year.

2-year Extension Waiver

While this law is in motion, the state acknowledges that some districts may face challenges in meeting the 2027 purchase requirements. To address this, districts that truly need extra time may apply for a 2‑year Extension Waiver. This waiver allows districts to continue receiving Transportation Aid for buses and contracts that do not yet meet zero‑emission requirements, while still advancing toward full fleet electrification.

2035 Full transition requirement still applies

Approved waivers do not extend the 2035 deadline. All districts are still expected to transition their entire fleets to zero‑emission by that date. Even with a waiver, districts are encouraged to continue advancing their fleet electrification plans.

Applying for an Extension

The Extension Waiver Application will be available through the SED Business Portal.
